§1 General provisions
1.1.
The online store “Dekoracyjnacegła.pl” belongs to:

1.2.
All prices quoted by Dekoracyjnacegła.pl, on the websites, in e-mail correspondence and telephone conversations are gross prices unless otherwise stated.
1.3.
Placing an order in any form implies acceptance of the provisions of these terms and conditions and the limitations and inconveniences that may arise therefrom (this is related to the specifics of the product).
1.4.
Dekoracyjnacegła.pl reserves the right to change the regulations.
§2 Product characteristics
2.1.
The sizes of tiles or corners may vary significantly.
2.2.
Our brick tiles are natural products, about 100 years old.
2.3.
There is a possibility:
- discoloration,
- mortar residues,
- color differences,
- chipping,
- depletions,
- chipped,
- cracks,
- uneven surfaces and edges,
- differences in dimensions.
2.4.
These are natural and desirable features of the product, not subject to complaint.
2.5.
It is allowed to crack up to 20% of the tiles during transport. This is due to the physical properties of the material from which the tiles were made (old bricks). This circumstance is acknowledged and accepted by the customer when making the purchase.
2.6.
The resulting products may be damp (this is related to the production technology), which may cause the packaging (boxes or cartons) to become dehydrated.
2.7.
In the case of storage of brick tiles more than 3 days after receipt, the customer is obliged to:
- Immediately unpack the pallet upon arrival,
- checking all of its contents,
- laying brick tiles separately,
- To provide them with a constant flow of air.
2.8.
Brick tiles that may be damp after the manufacturing process, which are sealed in packaging, are exposed to “steaming” (evaporation of water under the packaging and re-deposition).
2.9.
The specified square meter (tile) of the product in question includes a grout space of about 1-2 cm wide.
§3 Placing orders and entering into a contract
3.1.
The website Dekoracyjnacegla.pl stipulates that placing an order (even if it has been paid immediately) is equivalent to making an offer to the seller to purchase a specific product (which the store may accept or reject).
3.2.
The final conclusion of the contract of sale occurs only when the customer receives confirmation of acceptance of the order by the store in the form of an e-mail with the wording:
“Thank you for placing your order, your order is in process.”
3.3.
Order completion date: up to 21 working days from the date of receipt of payment (by: Dekoracyjnacegła.pl) for the ordered goods, regardless of how the order was placed.
§4 Delivery and collection of goods
4.1.
The customer is obliged to check the contents of the parcel in the presence of a representative of the courier company in case of damage or irregularities, after which this fact is immediately reported to Dekoracyjnacegła.pl.
In its absence, the complaint will not be considered.
4.2.
Applications:
- damage during transportation,
- or any discrepancy in the order
must be reported within 7 days of receipt of the shipment.
Otherwise, applications will not be considered.
4.3.
Free delivery applies to purchases of brick tiles with a gross value of more than PLN 5,000.00 in a single order.
§5 Payments
5.1.
Dekoracyjnacegła.pl accepts payments in the form of:
- cash payments (at the company’s headquarters),
- transfers to the company’s bank account.
5.2.
By making a purchase, the customer agrees to provide proof of purchase (fiscal receipt or invoice) in electronic form:
- at email address,
- in the body of the message or in the pdf file
specified when placing the order.
§6 Complaints
6.1.
The customer, being a consumer within the meaning of Article 22[1] of the Civil Code, has the right to file a complaint about the purchased goods or services within 14 days from the date of receipt of goods or services from Dekoracyjnacegła.pl.
6.2.
Complaints should be filed:
- By email to: biuro@dekoracyjnacegla.pl,
- or by mail to the company’s address.
6.3.
Complaints Filed:
- In another form,
- and reported after the deadline
will not be taken into account.
6.4.
Properly submitted complaints will be processed within 14 working days, calculated from the date of delivery of the complaint.
§7 Withdrawal from the contract
7.1.
A consumer has the right to withdraw from a contract concluded off-site within 14 calendar days without giving any reason. In this case, the contract is considered not concluded.
7.2.
The deadline for withdrawal expires after 14 days from the date:
- in which the Consumer took possession of the goods or in which a third party other than the carrier and indicated by the Consumer took possession of the goods;
- in the case of a contract involving multiple goods that are delivered separately – from the date on which the Consumer took possession of the last of the goods;
- in the case of a contract involving the regular delivery of goods for a certain period of time – from the date on which the Consumer took possession of the first of the goods.
7.3.
To exercise the right of withdrawal, the Consumer should inform the Seller of his decision by an unequivocal statement in writing (such as a letter sent by mail or e-mail).
7.4.
To comply with the deadline for withdrawal, it is sufficient to send information about the exercise of the right before the expiry of the 14-day period.
7.5.
In the event of withdrawal from the contract, the Seller shall return to the Consumer only the price paid for the goods, no later than 14 days from the date on which the Seller received the return of the goods.
7.6.
The payment will be refunded using the same payment methods used by the Consumer in the original transaction, unless the Consumer has expressly agreed otherwise.
7.7.
The consumer should send back or hand over the goods to the Seller immediately, but no later than 14 days from the day on which he informed about the withdrawal from the contract.
7.8.
The consumer bears the direct costs of returning the goods (the cost of returning the shipment to the Seller).
7.9.
The consumer is liable only for the diminution in value of the goods resulting from use beyond what is necessary to ascertain the nature, characteristics and functioning of the goods.
7.10.
The right of withdrawal does not apply in the cases specified in Article 38 of the Law on Consumer Rights, in particular for contracts:
- for the provision of services, if the entrepreneur has fully performed the service with the express consent of the Consumer;
- in which the subject of performance is a non-refabricated good, produced to the Consumer’s specifications or serving to meet his individualized needs;
- in which the object of performance is goods that, after delivery, by their nature, are inseparably combined with other things.
7.11.

§8 Personal data
8.1.
By using the website Dekoracyjnacegła.pl I agree to the processing of my personal data for the purpose:
- To present me with a product offer,
- presentation of services,
- conducting marketing by Dekoracyjnacegła.pl.

8.6.
Legal basis: the Law of August 29, 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended).
§9 Optional 5-year warranty
9.1.
In order to obtain the optional 5-year warranty for products purchased at Dekoracyjnacegła.pl, the customer is required to do the following:
9.2.
Purchase:
- Brick tiles (any type) in a minimum amount of 10m2,
- 2l of impregnant from the store dekoracyjnacegla.pl.
9.3.
The tiles must be installed in accordance with:
- decorativebrick.co.uk guidelines,
- The art of construction,
By persons or companies with certified qualifications in the installation of decorative tiles.
9.4.
The warranty applies only to the tiles:
- installed as decorative,
- indoors.
The tiles cannot be installed:
- In permanently humid environments,
- With large temperature differences,
- set in water.
9.5.
Tiles should be maintained:
- 1 coat of waterproofing,
- 1l for every 5m2 of tiles started,
- 1 time per year.
9.6.
Exclusions: the warranty does not cover the outcropping of efflorescence from natural elements such as salt on old brick tile surfaces.
9.7.
In order to receive the optional 5-year warranty for products purchased at Dekoracyjnacegła.pl, the customer is required to send an e-mail within 14 days from the date of the order:
message with a request to cover his order (stating the number) with an optional 5-year warranty.
9.8.
Failure to send such a request within the specified period will result in ineligibility for the optional 5-year warranty.
